Educational memo 15-03 How long does the Carrier have to recover an overpayment and how much at any one time?

On CSX sometimes we get paid incorrectly or get paid a claim that most likely shouldn't be paid by the Carrier. There are also instances where the Carrier pays the claim initially then relaizes (or believes) that an overpayment has been made.

When this happens the Carrier (CSX) has only a specific amount of time to do this, and they also by state laws, can only deduct a certain amount per week. The attached side letter and Article should be of help in what the Carrier can do and can't do.

Make sure the claims you enter in have proper language, and if you believe the Carrier is wrong in taking back the payment, make sure you give that claim to your Local Chairman.

Effective 1/1/15 per Attachment "A" item XIII of the 2014 SSA Agreement, Article 31 D was modified to allow for certain automated payments (i.e. Code 90 auto allowances, Code 57 Guarantee XB payments etc...) to have a review process of 6 months, meaning the carrier can adjust said payments 6 months from the date the payment is made. Again this applies to only certain "automated payments". If there is a question please let your Local Chairman know.
